Please read these terms carefully. By using any Web Hosters service, you agree to be bound by the terms set out below.

Section 1

Scope of Agreement

Web Hosters provides the service to the user on the terms and conditions set out below.

By entering the user's name and associated details into the required space to create a profile on the Web Hosters user portal and by logging into the Web Hosters account, the user (or his/her/its representative) indicates that the user irrevocably accepts these terms and conditions.

Please pay special attention to the terms shown in bold throughout this document.
Section 3

Interpretation

In these terms and conditions:

  • "Consumer Protection Act" means the Consumer Protection Act 68 of 2008.
  • "Web Hosters" means Web Hosters (PTY) LTD, a registered company which trades as Web Hosters.
  • "Web Hosters network" means the electronic communication infrastructure used by Web Hosters to provide internet access and bandwidth to the user.
  • "the service" means the provision of access to the Web Hosters network and related infrastructure in accordance with these terms and conditions.
  • "the user" means any person or entity that makes use of and purchases the service.
  • "reseller" means a user that has been given express permission to resell Web Hosters services.
  • "registered user" means the user that has entered their credentials into the Web Hosters user portal and who pays for the service.
  • "downgrade" means substituting a service that costs less than the initial service purchased by the user.
  • "Shaping" or "packet shaping" is a computer network traffic management technique which delays some or all datagrams/protocols to bring them into compliance with a desired traffic profile. Shaping is applied dynamically — no private user data is retained in this process.
  • "a calendar month" is the period between the first and the last day of any given month.
  • "Protocols" means network protocols that are formal standards and policies comprised of rules, procedures and formats that define communication between two or more devices over a network. Examples include HTTP, HTTPS, FTP, VOD, P2P.
  • "Top up" means a pre-paid voucher for additional data that is purchased once a user has reached their data cap/limit.
Section 4

Provision of Service & Authority

The user acknowledges that he/she has the prerequisite infrastructure in place to make use of the service. The user will be solely responsible for obtaining, configuring and maintaining all of their own equipment, including computer hardware, telecommunication equipment, modems/routers, smartphones, tablets and the like.

The user will be liable for all telephone call charges and other costs payable to third parties relating to obtaining and maintaining equipment as described above.

The user warrants that they have the authority and capacity to contract with Web Hosters for themselves or, where applicable, on behalf of any trust, close corporation, company or other entity they represent.

Section 5

Network, Availability & Acceptable Use

The Web Hosters network may be used to link into other networks in South Africa and universally. The user agrees to conform to the use policies of these networks.

The user may not circumvent authentication or security of any website, domain, host, network, or account — this constitutes a material breach of the service agreement and affords Web Hosters the right to suspend and/or terminate the service immediately without a refund.

Important: Web Hosters will make every effort to make the service available at all times, however Web Hosters does not guarantee or warrant 100% uptime and associated bandwidth speeds. All access to the electronic communications infrastructure is therefore rendered on a "best effort" basis.

Web Hosters will strive at all times to provide users with prior notice, where possible, of scheduled maintenance which may result in service interruption.

Web Hosters will not be responsible for the performance of external communications networks to which the service is connected, including the networks of Internet data providers other than Web Hosters.

Acceptable Use & Packet Shaping Policy

Web Hosters makes use of bandwidth packet shaping to ensure the network is not over-burdened. Protocols that may be subject to shaping include, but are not limited to: P2P/BitTorrent, NNTP, HTTP file hosting and certain Video on Demand (VOD) services.

Unshaped protocols: Browsing, email, Google services, FTP, Web Hosters hosted servers, VOIP.

Shaped protocols (Low priority): P2P torrents, HTTP/HTTPS downloads, file sharing downloads, NNTP downloads.

Shaped protocols (Medium priority): Streaming VOD, gaming, VPN/DNS/Proxy, file transfer, Windows/Apple/Linux updates.

Section 6

LTE-A / Fixed LTE

  • All hardware supplied by Web Hosters includes a 12-month manufacturer's warranty. Faulty hardware will be swapped out for a once-off courier cost of R199 per incident.
  • All Web Hosters LTE-A packages are "best-effort" services. Upload and download speeds cannot be guaranteed.
  • Early cancellation of any fixed-term LTE-A contract is allowed (as defined by Section 14 of the CPA 2008) but the user will be responsible for an early cancellation penalty of 3 × the normal monthly subscription.
  • Uncapped LTE-A solutions are only available on a 24-month contract basis and are subject to a Fair Use Policy.
  • Bandwidth caps are replenished on the 1st of every month. Any unused monthly data is forfeited at the end of each calendar month — data is not carried over.
  • Top-up data is valid for 30 days from date of purchase.
  • SIM cards will only be dispatched once payment is made for the 1st month. Delivery may take 7–10 working days.
  • It is the user's responsibility to fully insure the hardware for theft and damage.
  • Where Web Hosters provides hardware, the hardware remains the property of Web Hosters at all times.
Section 7

ADSL / VDSL

  • All hardware supplied by Web Hosters includes a 12-month manufacturer's warranty. Faulty hardware will be swapped out for a once-off courier cost of R199 per incident.
  • All Web Hosters ADSL/VDSL packages are rendered on a "best-effort" basis. Line performance and data speeds cannot be guaranteed.
  • Early cancellation of any fixed-term ADSL/VDSL contract is allowed (as defined by Section 14 of the CPA 2008) but the user will be responsible for an early cancellation penalty of 3 × the normal monthly subscription, plus hardware costs where applicable.
  • All ADSL/VDSL services where line installation/rental, data and hardware are bundled are subject to a 24-month contract.
  • Bandwidth caps are replenished on the 1st of every month. Any unused monthly data is forfeited — data is not carried over.
  • Hardware will only be dispatched once the required payment is made in full in advance. Installation is subject to Openserve/Telkom and may take 15–21 working days.
Section 8

Payment & Billing

All services are billed in advance. Web Hosters reserves the right to suspend or terminate the service if payment is not received by the due date.

A debit order authority allows Web Hosters to debit the user's bank account to facilitate payment for the service. The date, time and IP address are logged and constitute an electronic signature indicating acceptance of these terms.

Should a user sign up during a month other than on the 1st, billing will be done pro-rata for the remaining days of the particular month, billed together with the first full calendar month.

Add-on bundles are valid for 30 days from date of purchase. Any unused add-on bundle/value added service is forfeited at 23:59 on the expiry date.

Section 9

Cancellation

Month-to-month services may be cancelled at any time. Cancellation of month-to-month services must be requested before the next billing cycle to avoid being billed for the following month.

Fixed-term contracts may be cancelled early in terms of Section 14 of the Consumer Protection Act 68 of 2008, subject to the applicable early cancellation penalties as described in Sections 6 and 7 above.

Web Hosters reserves the right to terminate the service immediately and without notice if the user is found to be in breach of these terms and conditions, including but not limited to non-payment, abuse of the network, or illegal activity.

Section 10

Limitation of Liability

The user waives all and any claims that may arise as a result of Web Hosters being unable to make the service available due to circumstances beyond Web Hosters' reasonable control, including but not limited to third-party network failures.

Web Hosters' liability to the user in respect of any claim or loss arising from the use of the service shall be limited to the amount paid by the user for the service in the month in which the claim arose.

Web Hosters will fully cooperate with investigations of suspected criminal violations or network security breaches under the leadership of law enforcement or relevant authorities.

Section 11

Privacy

Web Hosters is committed to protecting user privacy. Personal information collected by Web Hosters is used solely for the purpose of providing the service and will not be sold or disclosed to third parties except as required by law or as outlined in the Web Hosters Privacy Policy.

Web Hosters and/or its upstream bandwidth provider may monitor the protocols used in bandwidth consumption to enable effective packet shaping management. No private user data is retained in this process.
